Chipotle’s lawsuit alleges that Sweetgreen’s “very similar and directly competing” bowls are an attempt to take advantage of the Chipotle brand and potentially confuse consumers. Sweetgreen said in a statement that it is aware of the lawsuit but does not comment on pending litigation. The company’s stock price fell more than % Early Wednesday afternoon. Chipotle Chief Corporate Affairs Officer Laurie Schalow said in a statement that the company will “take appropriate action where necessary” to protect its trademarks. Sweetgreen announced the bowl in March with a press release describing it as Strategy for the latest iteration of “Sweetgreen’s menu innovation, as the brand grows beyond salads, introducing bowls that don’t contain any veggies.” Chipotle’s The suit alleges that Sweetgreen used the word “Chipotle” in the same ad to advertise the bowl in the same font and style as the Mexican food chain, and used a background in the color of Chipotle’s trademark “Adobo Red.” Despite the cease and desist letters and phone calls, Sweetgreen continued to infringe. Chipotle said it proposed changing the name to use “lowercase chipotle, in a text sentence, to accurately describe the ingredients of its menu items,” such as “chicken bowl with chipotle.” Chipotle is seeking a court order restraining Sweetgreen from using the “Chipotle” name and an unspecified amount of damages.
