Judge Denies Pertsev bail for Tornado Cash
A Dutch judge ruled on Wednesday that the decision to issue the Tornado Cash protocol earlier this month Alexey Pertsev, the developer arrested for open source code, must serve at least another 90 days in jail.
The Bureau of Fiscal Information and Investigation announced earlier this month, Pertsev, 29, was detained on suspicion of engaging in “ concealment of criminal financial flows and promotion of money laundering” through Tornado Cash. Pertsev is one of several contributors to Tornado Cash’s open source code on Github. His arrest sparked outrage across the crypto community as enthusiasts questioned the legal status of a Dutch agency arresting someone for deploying code. The agency said it began investigating Tornado Cash in June.
Pertsev’s arrest was at the U.S. Treasury Department diplomacy Assets Control, whose office was arrested days later, approved Tornado Cash and its related smart contracts because of its popularity with cybercriminal groups such as the Lazarus Group. In its statement, the finance ministry took a similar stance against Dutch authorities, saying the agreement “has repeatedly failed to implement effective controls aimed at preventing it from laundering money for malicious cyber actors.” Following the announcement, several key crypto protocols and projects, including Alchemy, Infura, and Circle, complied with the ban immediately.
Pertsev was arrested at a hearing in Den Bosch today refused bail. He has not been formally charged with any crime, which is part of the reason his arrest sparked a backlash from crypto users. Congressman Tom Emmer (R-MN.) weighed in on the topic Tuesday, sending a letter to the Treasury Department questioning why it was targeting software. According to Emmer, the Sanctions Representative “is contrary to previous OFAC jurisprudence.”
